Failing Artificial Hips Are Creating Big Problems For Patients

Failing artificial hips are creating huge costs—both in terms of dollars spent and suffering for patients. As the New York Times says in a December 27, 2011 article, failing artificial hips are “the most widespread medical implant failure in decades.” Patients with these failing hips not only have to undergo additional surgeries to replace these faulty parts, but the costs associated with these replacements could cost taxpayers, employers, and insurers billions of dollars over the years, according to medical and legal experts. Costs for this complex situation will hit these stratospheric heights because, as the Times’ article explains, the failing artificial hips are not limited to a single manufacturer or implant model.

Some patients who must undergo surgeries to remove and replace defective hip implants have experienced complications such as having the bones that hold the implant fracture during surgery. Other complications such as infections can cause medical bills to increase dramatically.

Hips implants that are causing severe problems are metal-on-metal devices–both the ball and joint are made of metal, and some of these devices are seen to be failing within 3 years. Other artificial joints normally last 15 years or longer. The metal-on-metal hip implants also cause patients problems from the metal debris that flakes off of the joint as it moves. The metal debris lodged in surrounding tissue has crippled some patients.

More than 5,000 lawsuits and complaints have been filed against manufacturers of all-metal hip replacements, the Times’ reports, and insurers are letting patients know they intend to collect their expenses from any settlements patients receive from manufacturers. Medicare has also expressed similar intentions.

Up until recently, when numbers declined dramatically, all-metal hip replacements made up one-third of the approximately 250,000 hip replacements implanted in patients every year in the U.S. One estimate, according to the Times’ article, is that roughly 500,000 patients have had an all-metal hip replacement. According to one study, no artificial hip offered over a recent five-year interval—including some of the all-metal hip replacements—lasted longer than older implant types, and of the new implants introduced, 30 percent were worse than the older ones.

Johnson & Johnson’s DePuy division made the news last year when it recalled its all-metal hip replacement that had been implanted in 40,000 patients in the U.S. alone. The Times’ states that as of October, roughly 3,500 patients have lawsuits filed relating to those faulty implants.  Dr. Art Sedrakyan, a researcher at Weill Cornell Medical College of Cornell University, estimated that over the next ten years, tens of thousands of patients in the U.S. may have to have additional surgeries to replace the faulty implants.

Different manufacturers have responded in various ways regarding the costs associated with replacing defective implants. Zimmer Holdings, according to the Times, states its all-metal implants are safe, though they have settled hundreds of claims. DePuy is covering expenses associated with its recalled device, the Articular Surface Replacement, or A.S.R., but the Times reveals that some patients who took DePuy’s settlement have had difficulties connected with their medical bills. Some have had only a fraction of the costs covered, leaving the rest of the bills associated with the hip replacement surgery the patients’ responsibility.

In addition to the A.S.R. lawsuits, patients filed 560 lawsuits against DePuy for another all-metal hip replacement model known as the Pinnacle. For this implant model, though, DePuy states that it is working well, and patients needing a replacement for the Pinnacle are having to cover expenses with Medicare, insurance, or pay for it on their own. Rather than file lawsuits themselves against implant manufacturers, insurers will, in an effort to recover their expenses, let patients know through their lawyers that they expect to be reimbursed from the patients’ settlement money. While not everyone can afford to do it, some frustrated patients are paying out of pocket for hip replacement surgeries so they can walk again.

Teen Suffers Injuries in Vacaville Hit-and-run

The driver of an SUV hit a sixteen-year-old in Vacaville Tuesday night, December 27, 2011, and then abandoned the injured and unconscious teen. As reported by News 10 KXTV, Vacaville police Acting Sergeant Rod Neal stated that witnesses saw a maroon-colored SUV traveling north on Harbison Drive around 6:20 p.m. The vehicle then traveled on the sidewalk where it hit the teenager. The victim had been walking on the 3500 block of Harbison, and according to News 10’s story, the teen was headed from the Ulatis Library to the Morgan Park apartment complex.

Witnesses stated that after the SUV struck the young pedestrian, the driver kept heading down the sidewalk, hitting a pole and then some bushes before returning to the road.

Responders took the injured teen to Kaiser Permanente Vacaville Medical Center where the teen was treated for head trauma, abrasions, and pain, Sgt. Neal stated. The family of the teen reported that the victim’s condition was stable.

Investigators found parts of the SUV and followed a trail of fluid that led from the accident scene to a Target store parking lot on Harbison, according to Sgt. Neal. Investigators did not, however, locate the SUV, which may be a 2008 Toyota Sequoia.

Officers checked surveillance camera video from Target, and saw the SUV enter the parking lot. They then saw the driver park, enter the store, and rapidly exit and leave. No other information was available, and the investigation continues.

AAA Tipsy Tow Service for New Year’s Eve

“The Automobile Club of Southern California is offering its free Tipsy Tow service during the New Year’s Eve holiday for the 15thconsecutive year.  The community service is available from 6 p.m. on Friday, Dec. 30, to 6 a.m. on Sunday, Jan. 1, to help remove drinking drivers from the road.  Tipsy Tow is available in the 13 Southern California counties served by the Auto Club.”

If anyone needs a tow during those times, please call: 1-800-400-4AAA for a free tow home of up to seven miles. Don’t think you are “okay” to drive, it’s not worth the risk.
Callers need to keep in mind that the service excludes rides for passengers, is restricted to a one-way, one-time ride for the driver and the destination is limited to the driver’s residence.  Reservations are not accepted.  For rides farther than seven miles, drivers can expect to pay the rate charged by the tow truck contractor.

Collision in El Cajon Kills Skateboarder

A skateboarder riding across a road in El Cajon was hit by a vehicle Wednesday night. The skateboarder died at the scene. The accident happened a little after 6:00 p.m. on December 21, 2011, when the skateboarder was riding in the 1200 block of Jamacha Road according to Lt. Frank La Haye of the El Cajon police. As reported by NBC San Diego, a 20-year-old driver in a Nissan struck the skateboarder, and remained at the accident site. A witness, who happened to be passing by, attempted to administer first aid to the victim until paramedics responded, Officer La Haye said.

The identity of the victim was not released as of this writing. The investigation is continuing.

California’s New Child Booster Seat Law Takes Effect January 1, 2012

Beginning January 1, 2012, California’s new law that says children under 8 years of age must ride in a car booster seat will take effect. The law also states that children under 8 years old have to be buckled into a car seat or booster seat, and they must ride in the back seat. The California Office of Traffic Safety also stated in a recent press release that children 8 years old and older must also use a booster seat or car seat if they aren’t tall enough for the seat belt to fit them properly. Under the current law, children must ride in a booster seat until they are 6 years old or they weigh at least 60 pounds.

The director of the Office of Traffic Safety, Christopher J. Murphy, said in a recent statement that the new law is an important one, and will affect 1.1 million children in the state. He also said that keeping children in booster seats increases their chance of surviving a crash by 45 percent.

Booster seats work by making a child sit higher, boosting them up so that seat belts designed to fit adults will fit properly and provide appropriate protection for their small bodies. A seat belt fits properly when it restrains a passenger across the hip bones, not across the sensitive soft tissue and organs in the stomach and belly areas.  Seat belts not worn properly can cause serious injury in a collision if they cross the stomach instead of the skeletal structure. This is especially true for children whose bodies are not yet big enough for the seat belt to cross in the proper place to restrain them.

When the new law takes effect, most children can still ride in the booster seats they are already using. If the seat currently being used for a child is not adequate, new booster seats can be found at major retail outlets. The cost is around $15 to $20 for a low-back booster seat.

The fine for those who violate the law is big. Officers can ticket parents, if they are in the car, or the driver a hefty $475 or more for every child under the age of 16 who is not properly restrained. Violators will also receive a point on their driving record.

The Office of Traffic Safety has issued easy guidelines for determining if a child fits in an adult seat belt:

  • A child can sit with their back flush against the back of a vehicle’s seat with knees bent, and the child does not slouch or scoot down. The child can comfortably remain in this proper seated position for the duration of a trip.
  • The lap belt sits low on the hips and touches the upper thighs. It does not cross along the soft tissues of the stomach or belly.
  • The shoulder belt falls along the chest; it does not touch or cut into the neck or face.

According to the agency’s spokespeople, children must never be permitted to slip out of the shoulder belt and put it behind them, which is also true of all occupants of a vehicle. Riding with the shoulder belt behind the arm or back offers no protection or restraint to the upper body in the case of a collision. Head trauma and major injuries to the spinal cord can occur. According to the state agency, a sign that children still need a booster seat is if they’re putting the shoulder belt behind them. A shoulder belt that hits the face or neck causes chafing and is irritating. A booster seat, to raise an occupant to the proper height for the restraint device, will solve the problem and keep small people safer as they ride.

Doctors Evaluate Suspect who Killed 2-Year-Old in Accident

O.C. doctors are evaluating the suspect in a hit-and run case to see if mentally competent to stand trial.

The man stands accused of vehicular manslaughter while intoxicated after he hit a 2-year-old boy in Santa Ana.

Supposedly, the man drank four buckets of beer at a nearby Mexican restaurant and then drove off with his friend in his 1998 Toyota 4-Runner. While driving on Bewley Street near Fifth Street, he failed to yield for a family of pedestrians that were crossing the road. Among the pedestrians was the mother carrying her one year old daughter and a two year old boy, who was holding his mother’s hand.

Witnesses said that the driver ran a stop sign and hit the mother and her children. The boy was pulled under the vehicle upon impact and the mother and the daughter flew onto the hood of the car. The boy was taken to the hospital, but died en route from severe head trauma. The mother suffered a few scrapes and bruises and the daughter was unharmed.

If convicted, the suspect faces 16 years in prison.

Suspect in Several Hit-and-Runs Stopped after Hitting 9-Year-Old

A woman, who was a suspect in several hit-and-run cases, was detained by bystanders after they witnessed her strike a girl with her car and drag her for about 100 yards.

The suspect struck a vehicle near Garey Avenue and Phillips Boulevard and then left the scene. She continued driving south on Garey Avenue until she hit another vehicle. Then, jumping up onto the curb, she scattered pedestrians and hit a 9-year-old girl. The girl was dragged for about 100 yards before the driver hit a parked vehicle and was stopped by bystanders at the scene.

A witness told police that the woman was still trying to drive away, but someone reached into her car and took her keys and her cell phone while others restrained her.

The little girl was stuck under the car, which took six men to lift off of her. When she was freed, an ambulance took her to a medical center where she was examined. Medical authorities reported that she only suffered minor injuries.

The driver is being held in Pomona jail in lieu of $50,000 bail.

Driver Still at Large in Fatal Hit-and-Run Accident

The police of East Los Angeles are still seeking the driver of a blue Subaru Impreza that killed a 22-year-old man in a hit-and-run accident on December 15th.

The young man was crossing through the intersection of Olympic Boulevard and Simmons Avenue when the driver failed to yield to him.

The man was transported to a hospital where he later died of his injuries. He leaves behind his wife and his 2-year-old daughter.

Fire Captain Sentenced in DUI Hit-and-Run Case

A Long Beach Fire Captain was sentenced in a DUI hit-and-run case after he hit cyclist while driving with a blood alcohol level three times the legal limit.

The captain was accused of drinking heavily at a Seal Beach bar before getting behind the wheel of his Chevrolet pick-up and driving down Westminster Avenue. The Seal Beach police received several reports of a pick-up driving erratically before getting a 9-1-1 call stating that a cyclist had been hit. The captain then continued to drive away.

The cyclist suffered severe head trauma, broken bones and internal bleeding according to reports.

The fire captain was sentenced to five years of probation and one year in jail as well as a $102,000 restitution fee.

Police Officer Kills Two People Crossing the Street

A police officer killed two pedestrians while they were walking a motorbike across the street.

The two people, a 24-year-old male and a 30-year-old woman, were walking a motorcycle across the street to get more gas when they were struck by a police car. Witnesses say that the police car was driving at twice the speed limit and did not have his sirens or headlights on, even though it was nighttime.

The police department said that they think the officer was responding to a call and had not yet turned his lights on because he was in a hurry.

The male victim leaves behind a wife and two children and the woman leaves behind three children.

No charges have been filed against the police officer.
